Terms and Conditions of Sale – Euskal Conseil

1. Scope
These Terms and Conditions of Sale (CGV) apply to all services offered online by Euskal Conseil, a sole proprietorship registered under number 88327182700023, with its registered office in Saint-Pée-sur-Nivelle, via the website www.euskalconseil.com.
Any order implies the client’s full and unconditional acceptance of these Terms.
2. Services Offered
Euskal Conseil provides services in marketing consultancy, digital strategy, content writing, personalized support, and remote training, as described on the website.
Services may be purchased individually, as packages, through monthly subscriptions, or by the hour, depending on the option chosen by the client.
3. Orders and Validation
Orders are placed directly online via www.euskalconseil.com. By validating the order, the client fully accepts these Terms and Conditions without exception.
A confirmation email with the service details is sent to the client upon order completion.
4. Pricing and Payment Terms
Prices are displayed in euros (€), VAT excluded (VAT not applicable according to Article 293 B of the French General Tax Code).
Payment is made online by credit card, bank transfer, or through a secure payment solution. Services will only begin once full payment has been received and confirmed.
In the case of a subscription, billing is automatic on a fixed monthly date, unless cancelled under the conditions stated in Article 8.
5. Service Execution
Services are provided remotely, according to a schedule agreed upon with the client, upon receipt of payment.
The client agrees to provide all necessary information for the proper execution of the service. Any change requests will require a new agreement.
Euskal Conseil reserves the right to refuse a project if it falls outside its area of expertise or if the collaboration conditions do not allow for professional and ethical work.
6. Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to services that are fully executed before the end of the 14-day withdrawal period, or when execution has begun with the client’s express consent.
By validating the order, the client expressly waives the right of withdrawal once the service has started.
7. Liability
Euskal Conseil undertakes to provide services with professionalism, diligence, and in accordance with industry standards. However, it cannot be held liable in cases of force majeure or if the client fails to implement the recommended actions.
Euskal Conseil does not guarantee specific results in terms of revenue, web traffic, or SEO ranking, as these depend on various external factors.
8. Cancellation
For one-off services, no refunds will be issued once the service has started.
For monthly subscriptions, cancellation is possible at any time with a 7-day notice before the next billing date. Cancellations must be sent via email to: [email protected].
9. Intellectual Property
All content created by Euskal Conseil in the course of providing services (texts, materials, recommendations) is protected by copyright. It may not be distributed or used for other purposes without written authorization.
The client retains ownership of all data and documents provided to Euskal Conseil.
10. Confidentiality
Euskal Conseil commits to respecting the confidentiality of all information exchanged with the client in the context of service delivery. No data will be shared with third parties without the client's prior consent.
11. Personal Data
Euskal Conseil only collects data necessary for order management and customer relations. In accordance with French data protection law and the GDPR, the client has the right to access, rectify, and delete their personal data.

GDPR – Article 13
In accordance with the General Data Protection Regulation (GDPR), the data collected (name, surname, email address, company, phone number, browsing data) is used solely within the framework of the commercial relationship, for contract execution or to provide information related to the purchased services.

Data is retained for 3 years following the last commercial interaction, unless otherwise required by law.

Technical Access Requirements
The client confirms having the necessary computer equipment and internet connection to access the services offered. Euskal Conseil cannot be held liable in the event of access issues due to the client’s equipment or network failure.
12. Disputes and Governing Law
These Terms and Conditions are governed by French law. In the event of a dispute, an amicable solution will be sought. If no agreement is reached, the competent court will be that of Euskal Conseil’s registered office.
